AGREEMENT FOR FINANCIAL CONSULTING, DATA FURNISHING, AND CREDIT MONITORING SERVICES

1. SERVICES PROVIDED

1.1 Data Furnishing Services

• Report the Client's monthly payments to major credit bureaus (Experian, Equifax, TransUnion) as a positive tradeline.
• Assist the Client in structuring financial payments to build creditworthiness.
• Provide financial guidance on credit optimization strategies.
• Offer continuous monitoring and reporting services to maintain active accounts.

1.2 Financial Consulting Services

• Review the Client's financial profile and credit report for inaccuracies.
• Advise on financial strategies to improve creditworthiness.
• Assist in preparing administrative documents for financial restructuring.
• Consult on negotiation strategies with creditors for debt resolution.

1.3 Credit Monitoring and Express Consulting Services

• Enroll the Client in a 12-month credit monitoring service with real-time alerts and monthly updates.
• Provide personalized credit consulting to dispute inaccuracies and improve credit utilization.
• Offer monthly progress reports and strategic planning sessions.

Note: The Consultant does not function as a credit repair company or guarantee specific credit score improvements. Services are advisory only.

2. FEE STRUCTURE AND PAYMENT TERMS

2.1 Data Furnishing Fees

• Initial Credit Building Fee: $1,685 divided into 12 monthly installments of $140.42.
  • Upfront payment of $842.50 allows the first 6 months to be reported as "paid on time."
• Ongoing Membership: $20/month after 12 months for continuous credit reporting.
• Additional Reporting Services: Fees for rental/utility reporting will be detailed in a separate schedule.

2.2 Consulting Fees

• Standard Consulting: $1,685 upfront (50% due at signing; 50% upon resolving $5,000+ debt).
• Express Consulting: $2,245 (50% upfront; 50% upon resolving $5,000+ debt).
• High-Debt Fees:
  • $51,000–$99,000: $2,395 + 1% success fee.
  • $100,000–$249,000: $2,395 + 1.5% success fee.
  • $250,000–$500,000: $2,395 + 2% success fee.

2.3 Credit Monitoring Fees

• Monthly Membership: $20/month (automatically debited).
• Penalties: $10 fee for failed payments; services suspended after two failed attempts.

Payment Methods: Bank transfer, credit card, or electronic payment.

3. CLIENT OBLIGATIONS

The Client agrees to:

• Provide accurate personal/financial information (ID, Social Security card, utility bill).
• Maintain active credit monitoring with all three bureaus.
• Ensure timely payments for uninterrupted reporting.
• Notify the Consultant promptly of payment issues or financial changes.

4. CONSULTANT OBLIGATIONS

The Consultant agrees to:

• Accurately report payments to credit bureaus in Metro 2 format.
• Provide monthly updates and credit review reports.
• Maintain confidentiality and data security (encryption protocols).
• Enroll the Client in third-party credit monitoring within 3 business days.

5. CONFIDENTIALITY AND DATA SECURITY

• All shared information remains confidential.
• The Consultant retains data for 12 months post-termination unless deletion is requested in writing.
• Data encryption and security measures are implemented.

6. LIMITATION OF LIABILITY

The Consultant's liability is limited to fees paid. The Consultant is not liable for:

• Credit score fluctuations or third-party bureau decisions.
• Financial losses due to Client non-compliance.
• Delays in credit reporting or technical issues with third-party services.

7. DISPUTE RESOLUTION

• Disputes resolved via binding arbitration (American Arbitration Association).
• Legal proceedings in New York State jurisdiction.

8. CANCELLATION AND REFUND POLICY

8.1 General Cancellation

• Cancel within 3 business days without penalty.
• No refunds after services are rendered or credit bureau reporting begins.

8.2 Credit Monitoring Cancellation

• Cancel before 90 days: $50 fee.
• Cancel after 90 days: No refunds; service continues until the next billing cycle.

8.3 Refund Conditions

• Refunds available if services are not commenced or for administrative errors.

9. GOVERNING LAW

This Agreement is governed by the laws of New York State.

10. ENTIRE AGREEMENT

This document supersedes all prior agreements and constitutes the entire understanding between the parties.
